These Terms of Service ("Terms") are an agreement between you and Harmi ("Harmi", "we", "us", or "our") that governs your use of the Harmi application and website at harmiapp.com (together, the "Service"). Harmi is an independent music-learning app operated by its creators, based in Texas, United States. Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You may use the Service if you can form a binding contract with us under applicable law. To create an account, you must be at least 13 years old, and by creating one you confirm that you are. Users under 13 may use Harmi to learn without an account, and should do so with the involvement of a parent or guardian. If you are between 13 and the age of majority where you live, you should review these Terms with a parent or guardian.
Creating an account is optional and lets your progress sync across devices. We use passwordless sign-in: you sign in with a one-time "magic link" sent to your email address. You are responsible for keeping access to your email account secure, since anyone with access to it could sign in to your Harmi account. Accounts are for individual use; please don't share your account or impersonate anyone else. You can delete your account at any time from Account settings within the app.
Harmi provides interactive lessons, drills, and games designed to help you learn to read and understand music. The Service is provided for your personal, non-commercial learning and enjoyment. We are continually improving Harmi, so features, lessons, and content may change, be added, or be removed over time.
Harmi includes virtual items and currencies such as hearts, shields, "Notes," experience points (XP), stars, and ranks. These exist only within the Service to support learning and motivation. They have no monetary value, are not your property, cannot be redeemed for cash or any real-world value, and cannot be transferred or sold. We may adjust, reset, or remove virtual items at any time as we develop the Service. If we ever introduce paid features or purchases in the future, those will be governed by additional terms presented at that time and, where applicable, by the rules of the app store through which you obtained Harmi.
When using the Service, you agree not to:
The Service and its content - including lessons, curriculum, text, graphics, audio, the "Harmi" name and logo, the Harmi character, software, and design - are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial learning. This license does not transfer any ownership rights to you, and all rights not expressly granted are reserved.
If you choose to send us feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or obligation to you, so that we can improve Harmi.
The Service relies on third-party providers (such as our hosting, email, and analytics providers) and may be distributed through third-party app stores. Your use of those services may also be subject to their own terms. If you obtained Harmi through an app store, you agree to comply with that store's applicable usage rules, and you acknowledge that the store is not responsible for the Service.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular learning outcome will be achieved. Harmi is an educational tool, not a guarantee of musical proficiency.
To the maximum extent permitted by law, in no event will Harmi or its creators be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100), or, if you have paid us any amount in the twelve months before the claim, the greater of that amount or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Harmi and its creators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.
You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page, and for significant changes we will provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction - except where applicable law gives you the right to bring a claim in your local courts.
If you have any questions about these Terms, email us at support@harmiapp.com.
